Moumeche struck Mr. Clarke with a single punch at Derby bus station on May 6, 2021, causing Mr. Clarke to fall and fracture his skull. Mr. Clarke passed away in the hospital nine days later.
The court heard that Mr. Clarke had confronted a group of three teenagers about their behavior on an escalator at the Eagle Market, which led to the altercation at the bus station. Moumeche, now 18, was found guilty of manslaughter following a trial at Derby Crown Court.
Mr. Clarke's family described him as a kind and loving man who was a regular churchgoer and an energetic family man. Judge Shaun Smith accepted psychological reports indicating that Moumeche had an emotional age of about 13 at the time of the incident. However, the judge noted that Moumeche could have walked away from the confrontation but chose to get involved and strike Mr. Clarke with a deliberate blow.
The judge stated that while Moumeche was prone to outbursts of anger, he did not pose a risk to the public. Moumeche had faced two trials, with the original jury being unable to reach a verdict in the summer of 2022.
