Ireland to Ban Goods, Not Services, from Israeli Settlements

The Irish government confirms plans to prohibit the import of goods from illegal Israeli settlements while omitting services from its legislative agenda.
Ireland’s Deputy Premier, Simon Harris, announced that the government will pursue a ban on goods originating from illegal Israeli settlements on Palestinian land, while clarifying that services will not be included in this prohibition.

This decision follows extensive discussions regarding the Occupied Territories Bill, which was first introduced in the Irish parliament in 2018. The bill originally aimed to restrict trade in both goods and services from all illegally occupied territories, explicitly covering Israeli settlements.

The recent change in focus was influenced by legal considerations, as Harris indicated that a ban on services may not be legally feasible.

In 2022, the United Nations’ International Court of Justice (ICJ) issued an advisory opinion recommending that countries take action to avoid trade that supports illegal settlements.

However, the interpretation of this ruling appears to differ among political factions in Ireland.

Former Prime Minister Micheál Martin, now serving as Ireland’s premier, previously asserted that the ICJ's opinion could offer a strong rationale for enacting the Occupied Territories Bill.

Nevertheless, in January 2023, Martin suggested that the original bill might be supplanted by new legislation, prompting concerns from advocates that this could lead to a reduction in the scope of the proposed bans—specifically the exclusion of services.

During parliamentary discussions, Harris reiterated that the focus will remain on ‘goods from the occupied Palestinian territory’ as outlined in the government’s program.

He stated, 'The mandate I’ve received, and that’s what I’m now progressing.' He emphasized that the government is committed to creating a law that is compliant with both EU and domestic legal standards, stating that passing a law not in compliance would be 'irresponsible.'

Sinn Féin's spokesperson for foreign affairs, Donnchadh O Laoghaire, criticized the government’s approach, suggesting that legal technicalities are being employed as a distraction from policy changes since the November elections.

He argued that the ICJ did not differentiate between goods and services in its opinion and questioned the reasoning behind the government's decision to exclude services from the forthcoming legislation.

Harris acknowledged the complexities involved in legislating for this issue, indicating that the government would continue to 'constructively engage' on the matter while ensuring any laws passed are lawful and operational.

He further expressed concern about increasing tensions in the Middle East, particularly following remarks from Israeli Prime Minister Benjamin Netanyahu regarding the potential cessation of the ceasefire in Gaza if hostages are not released.

Harris emphasized the importance of maintaining humanitarian aid and ensuring the safety of hostages.
