Charities Warn Against Loopholes in UK Online Safety Act Regarding Child Protection

A coalition of charities raises concerns about the implications of the Online Safety Act for children's safety on encrypted messaging platforms.
A coalition of charities has expressed concerns that the protections for children against online sexual abuse may be insufficient under the current plans of the Online Safety Act.

In a letter addressed to Home Secretary Yvette Cooper and Technology Secretary Peter Kyle, organizations including the NSPCC and Barnardo’s highlighted what they describe as an 'unacceptable loophole' that could allow encrypted messaging services to evade responsibility for removing illegal content.

The charities refer to specific language in the codes of practice issued by the UK's online safety regulator, Ofcom, which states that platforms must remove illegal content where it is 'technically feasible.' This phrase is interpreted by the charities as a potential justification for encrypted messaging services to argue that they are not accountable for the removal of illegal content, including material related to child sexual exploitation and abuse (CSEA).

End-to-end encryption, employed by various messaging platforms such as WhatsApp, secures messages so that only the participants in a conversation can access the content, preventing even the service providers from viewing it.

This technology is at the center of the debate, balancing user privacy against the need to combat online abuse.

In their letter, the charities expressed deep concern regarding the potential consequences of the Ofcom codes, stating that they could enable some services to evade what they view as fundamental protections for children.

They provided examples of scenarios in which children might be victims of sexual extortion through the distribution of nude images or might encounter child sexual abuse material in group chats.

The letter asserts that these situations could result in harmful content remaining accessible and reportable only with uncertainty, thereby perpetuating risks to children online.

The issue of encrypted communications has gained renewed attention as reports emerged indicating that the UK government had requested Apple to grant access to encrypted files stored in the cloud.

Internationally, police and security agencies have raised alarms over the challenges posed by encryption, suggesting it allows sophisticated criminal activities to flourish, thereby impeding investigations into terrorism and child exploitation.

Tech companies, however, maintain that encryption is crucial for user privacy.

They warn that any backdoor access for governments might be vulnerable to misuse by malicious actors or oppressive governments.

The charities have urged the UK government to clarify how they will fulfill their safeguarding responsibilities, advocating that private messaging platforms should not transform into havens for severe online abuse.

An Ofcom spokesperson responded to these concerns, stating that while the laws require measures to be technically feasible, they anticipate that the vast majority of platforms will effectively manage content removal.

Ofcom plans to hold these platforms accountable for failing to comply with safety measures, which will include responsibilities to review and report child sexual abuse material to law enforcement.

Statistics from the Home Office reveal that over the past year, police forces in England and Wales recorded more than 38,000 offenses related to child sexual abuse images, averaging over 100 cases daily.

The Internet Watch Foundation (IWF), which actively works to identify and eliminate CSEA material online, also echoed concerns about the attributes of the current codes of practice, labeling the present wording a 'blatant get-out clause' that may enable platforms to sidestep compliance with online safety laws.
