UK Equalities Regulator Questions Scottish Government's Guide on Transgender Staff Facilities

The Equality and Human Rights Commission expresses concerns over single-sex facility policies amid an ongoing employment tribunal involving NHS staff.

The Equality and Human Rights Commission (EHRC) has contacted both the Scottish Government and NHS Fife regarding staff access to single-sex changing facilities.

The EHRC expressed a desire to meet with Health Secretary Neil Gray to discuss a forthcoming publication titled "guide to transitioning," which has sparked media attention and raised questions about its compliance with the Equality Act 2010.

The concerns by the EHRC follow a high-profile employment tribunal involving nurse Sandie Peggie, who is challenging NHS Fife and a transgender colleague, Dr. Beth Upton, over being required to share female changing rooms at the Victoria Hospital in Kirkcaldy.

Peggie was suspended after voicing objections to Dr. Upton's access to the changing rooms on December 24, 2023.

In a letter addressed to both John Swinney and Health Secretary Neil Gray, the EHRC indicated its apprehension regarding how the upcoming guide might portray the provisions of the Equality Act.

Reports suggest the document stipulates that transgender NHS staff should be permitted to use their preferred facilities unless a case-by-case justification against it is provided; however, the guide is currently not available on any government websites.

The EHRC's letter stresses the necessity for health bodies in Scotland to have a proper understanding of the Equality Act 2010 concerning the provision of single-sex services and facilities.

It emphasized that policies must consider the rights of all protected characteristic groups and take measures to mitigate discrimination risks.

The EHRC has requested that NHS Fife publish its assessments related to new policies affecting equality legislation, highlighting the absence of this information on the health board's website.

Baroness Kishwer Falkner, chairwoman of the EHRC, underscored the importance of compliance with the Equality Act across health bodies in Scotland, England, and Wales.

She reaffirmed the agency's role in promoting adherence to equality legislation.

The tribunal involving Peggie has also been a topic of discussion in the Scottish Parliament.

During First Minister’s Questions, Russell Findlay, leader of the Scottish Conservatives, characterized the issue as stemming from what he termed “gender ideology” pursued by the Scottish Government.

In response, Swinney accused Findlay of attempting to “sow division” while reflecting on the law's limitations regarding comments on ongoing tribunal cases.

The tribunal is currently adjourned, with plans to reconvene in July.

In light of the EHRC's letter, a spokesperson for NHS Fife acknowledged receipt and indicated that a full response would be forthcoming.

A Scottish Government spokesperson similarly confirmed that they would respond to the EHRC.

The spokesperson reiterated the Scottish Government's expectation for compliance with the requirements of the Equality Act 2010, while also mentioning the need for organisations to consider other legislative impacts, such as health and safety laws in workplace settings.

The Scottish Government maintains support for the separate and single-sex exceptions in the Equality Act, allowing for potential exclusion of trans individuals when deemed a proportionate means to achieve a legitimate purpose.
