The US Supreme Court has ruled in favor of Jack Daniel's in a trademark dispute with VIP Products, a dog toy company that produces a toilet-themed product resembling Jack Daniel's signature whiskey bottle.

The court stated that the matter will now focus on whether the Bad Spaniel marks are likely to cause confusion for consumers, and whether the toy misleads customers, profits from Jack Daniel's hard-earned goodwill, and associates its whiskey with excrement.

The toy, which sells for around $20, features a dog's face and says it is "43% Poo by Vol." and "100% Smelly." The lower court had previously ruled in favor of VIP, arguing that the toy was an "expressive work" and had not tainted the brand.
