The couple was detained at their home in Borehamwood, Hertfordshire, in front of their daughter, and held for eleven hours in a police cell before being released without charges.
The arrest followed complaints made by the couple regarding the leadership at Cowley Hill Primary School, where they had previously been banned from entering.
This ban stemmed from their criticisms of a head teacher recruitment process and their public discourse in a parents' WhatsApp group.
The couple reported that the restrictions on their access to the school also hindered their ability to provide critical medical information about their daughter, Sascha, who is disabled, neurodivergent, and suffers from epilepsy.
Hertfordshire Constabulary stated that the arrests were deemed necessary to fully investigate allegations of harassment and malicious communications, which are classified as criminal offences.
Following the investigation, police authorities determined that insufficient evidence warranted no further action.
The couple indicated that their concerns regarding the school’s management and recruitment processes were rebuffed in previous communications, including a letter Mr. Allen sent to the school in May 2024. They claimed to have sent around 45 emails related to their daughter’s needs during a six-month period of enforced communication restrictions.
The police had been alerted to the situation after the school reported an increase in direct correspondence and public posts from the couple, which were said to be distressing for school staff, parents, and governors.
The school stated it sought police advice due to the concerning nature of the communications, and the chair of governors warned parent bodies about potential consequences of inflammatory or defamatory remarks.
Mr. Allen articulated his disbelief at the escalation of events, stating that they had never employed abusive or threatening language in their communications.
He characterized the situation as 'Kafkaesque,' noting their request for clarification on the specific communications that allegedly constituted criminal behaviour went unanswered.
Following a warning issued by an officer in December, the family began to consider alternative educational arrangements for their daughter, ultimately withdrawing her from Cowley Hill Primary School prior to the arrest.
The couple expressed that they aimed to raise legitimate inquiries regarding their daughter's education and care, claiming their communications were within the bounds of appropriate parental engagement as defined by the school’s complaints procedure.
