The court ordered the Home Office to process the family's application without the biometric data, asserting the refusal was disproportionate and violated the right to family life under Article 8 of the European Convention on Human Rights.
The man, whose identity is protected, received asylum in the UK in 2023 amidst the Gaza war. With refugee status, he was entitled to apply for family-reunion visas for his relatives.
Despite the family's application in December and the severe difficulties in leaving Gaza, particularly during the current conflict and disease outbreaks, the Home Office initially denied their exemption request. The family faced life-threatening conditions, including hepatitis A among the children.
Previously, the UK announced efforts to assist British nationals and their families to evacuate Gaza, providing support in Cairo. Now, with the legal victory, the man's family can apply for visas to join him in the UK. The Home Office has accepted the court's decision but declined further comment.
