Powell stated that he believed the detainee, Fathal Moshen, posed a "real viable threat" to him. The incident occurred in July 2021 after Moshen was arrested for reportedly threatening to stab someone in Newport.

PC Powell explained that during the arrest and while in custody, Moshen's behavior was described as "volatile" and "very aggressive." He claimed that Moshen had made threats and gestures, and he perceived Moshen's actions as potentially dangerous, especially during the ongoing COVID-19 pandemic, as he had a newborn son with respiratory issues at home.

The situation escalated when Moshen attempted to remove a spit hood placed over his head. PC Powell said that he had "no option but to use my knee" to control the situation, and he struck Moshen three times in the chest with his knee.

The misconduct hearing will examine whether PC Powell's actions constituted excessive force and whether they amounted to gross misconduct. PC Powell denies the allegations, arguing that he acted within his rights given the perceived threat and dynamic nature of the situation. The hearing will assess whether his actions were proportionate, reasonable, and necessary.
