Al-Nashiri is seeking to have his complaint heard by the UK's Investigatory Powers Tribunal (IPT), arguing that there is an "unavoidable inference" that the UK agencies were complicit in his mistreatment.
Al-Nashiri was captured by the CIA in 2002 and held in secret prisons and Guantánamo Bay before being transferred to the US military commission in 2006.
He is currently facing the death penalty for his alleged role in the 2000 bombing of the USS Cole.
The UK government argues that the IPT does not have jurisdiction to hear al-Nashiri's application.
