The initial investigation by the Parliamentary Commissioner for Standards had found three claims of sexual misconduct to be upheld, but the IEP has now ruled that the investigation was flawed and ordered a reinvestigation.
Warburton resigned as an MP on June 18th, after admitting to taking cocaine.
The by-election to find a successor will be held on July 20th.
The original investigation into Warburton's conduct was centered around one woman's claims, but the IEP sub-panel found that the evidence was not adequately tested and other evidence was omitted.
The panel made no findings on the substance of the complaint, but due to the serious nature of the allegations, a reinvestigation was deemed necessary.
