Sergey and Maria Grazhdankin won a court case against their upstairs neighbors, Medhi Guissi and Meriem El Harouchi, over noise issues in their West Kensington apartment.
The Grazhdankins filed a lawsuit due to unbearable noise after Guissi and El Harouchi replaced carpets with wooden flooring, which was poorly installed, compromising the acoustic barrier.
The court ruled in favor of the Grazhdankins, awarding them £16,087.50 in damages and ordering the defendants to cover a substantial part of the £250,000 legal fees.
The Grazhdankins experienced significant daily disturbances, especially early in the morning and on weekends, due to the changed layout of the upstairs apartment.
The defense argued that the noises were typical for a family home and not intentionally disturbing. However, the judge recognized the Grazhdankins' distress and ruled that the faulty flooring installation led to the excessive noise. Additional court proceedings will determine the specific allocation of the legal costs.
