Australian Woman, 62, Secures Legal Victory to Use Deceased Husband's Sperm

A 62-year-old Australian woman has won a court case allowing her to collect her deceased husband's sperm.

The decision came after she demonstrated their shared intention to have a child, particularly after losing their 31-year-old son in a car crash in 2019 and their 29-year-old daughter who drowned in 2014.

Following her husband's death on December 17, the woman, whose identity is protected, requested the preservation of his sperm from the hospital morgue. Faced with inaction from the hospital, she obtained an emergency court ruling from the Supreme Court of Western Australia.

Timing is crucial for sperm retrieval, with experts recommending it occur within 48 hours post-mortem. Justice Fiona Seaward authorized the sperm's collection and storage; however, usage for fertilization will require additional legal approval.

The legal ruling, issued on December 21, has only recently become public knowledge. While rare, this case reflects a growing number of similar instances in Australia, including a June 2023 case where a woman received consent to extract sperm from her 29-year-old husband posthumously.
